Atlantic Watersports terms & conditions

These Terms and Conditions (“Agreement”) govern the use of services provided by Atlantic Watersports (“Company,” “we,” “us,” or “our”), including but not limited to jet ski rental, watersports rental, jet car rental, personal watercraft (PWC) rentals, drone services, and related recreational activities within the State of Florida.

By booking, participating in, or using any of our Services, you (“Participant,” “Customer,” “you”) agree to be legally bound by this Agreement.

Pursuant to Florida law, you acknowledge that participation in watersports activities, including jet ski rental and jet car rental, involves inherent risks that cannot be eliminated regardless of the care taken. These risks include, but are not limited to:

• Serious bodily injury or death
• Drowning
• Collision with vessels, fixed objects, or swimmers
• Equipment failure or malfunction
• Weather, water, and marine conditions
• Actions or negligence of other participants

You knowingly and voluntarily assume all risks, whether foreseen or unforeseen, inherent or otherwise, associated with participation in any Atlantic Watersports activity.

To the fullest extent permitted under Florida law, including but not limited to Section 768.28 and applicable Florida common law, you hereby release, waive, discharge, and covenant not to sue Atlantic Watersports, its owners, officers, employees, agents, contractors, affiliates, successors, and assigns from any and all claims, causes of action, demands, damages, losses, or liabilities, whether arising from:

• Negligence (active or passive)
• Premises liability
• Equipment use or misuse
• Supervision or instruction
• Any act or omission of Atlantic Watersports

This release applies to claims for personal injury, death, or property damage, whether occurring on land or water.

You agree to indemnify, defend, and hold harmless Atlantic Watersports from any claims, losses, damages, costs, or expenses (including attorney’s fees) arising from:

• Your participation in any jet ski rental or watersports rental
• Your violation of Florida boating laws
• Injury or damage caused to third parties
• Breach of this Agreement
• 
  

You agree to comply with all Florida Fish and Wildlife Conservation Commission (FWC) regulations and applicable statutes, including but not limited to:

• Florida Statutes Chapter 327 (Vessel Safety)
• Minimum age and boater education requirements
• Safe operation and speed restrictions
• No operation under the influence of drugs or alcohol

Failure to comply may result in immediate termination of your rental without refund and possible law enforcement involvement.

• Operators must meet Florida age requirements for personal watercraft operation.
• Proof of boater safety education may be required.
• Valid government-issued photo ID is mandatory.
• Atlantic Watersports reserves the right to deny service to any person deemed unsafe, impaired, or noncompliant.

You accept full responsibility for:

• Loss, theft, or damage to jet skis, jet cars, and watersports rental equipment
• Mechanical damage caused by misuse or negligence
• Towing, recovery, or environmental cleanup costs

You authorize Atlantic Watersports to charge your credit card on file for damages or losses.

Atlantic Watersports reserves the right to cancel or modify rentals due to weather, water conditions, mechanical issues, or safety concerns. No refunds are guaranteed due to Acts of God, including storms, tides, or marine hazards.

Drone footage is provided as-is and may be affected by FAA regulations, weather, or technical limitations. Atlantic Watersports is not responsible for incomplete or unusable footage.

To the maximum extent permitted under Florida law, Atlantic Watersports shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of enjoyment, loss of income, or emotional distress.

You grant Atlantic Watersports the irrevocable right to use photographs or videos taken during your jet ski rental, jet car rental, or watersports rental for promotional, marketing, and advertising purposes without compensation.

This Agreement shall be governed exclusively by the laws of the State of Florida, without regard to conflict-of-law principles. Venue for any legal action shall lie solely in the courts of the county in which Atlantic Watersports operates.

If any provision of this Agreement is held unenforceable under Florida law, the remaining provisions shall remain in full force and effect.

By booking, signing a waiver, or participating in any Atlantic Watersports activity, you acknowledge that you:

• Have read and understood this Agreement
• Understand that you are waiving legal rights under Florida law
• Voluntarily agree to be bound by these Terms and Conditions
